General Conditions of Sales

I Application

These general conditions of sale (hereinafter: “GCS”) apply to sales operations concluded by Hostellerie Le Mirabeau with the Customer.

They cancel and replace any previous version that may have been put online and/or accepted by the Customer.

These GCS apply to any use of the site, in particular to the marketing by internet and telephone of all the services offered on the Site by the Company SARL L’orangeraie.

It is therefore imperative that the Customer carefully reads the GCS which are referenced by hypertext link on each page of the site. In particular, he is advised to download and/or print them in order to keep a copy on the day of his order as soon as they are likely to be modified, it being however specified that such modifications will be inapplicable to orders for Services made previously.

The GCS may be supplemented by specific conditions of sale appearing on the description of the service as well as by the conditions of sale of the service providers, accessible either on their Website or on site.

 

II Capacity

The Customer acknowledges having the capacity to contract, that is to say to have the legal majority and not to be under curatorship or guardianship.

The Customer also declares to use the Site in accordance with these GCS, in his name and in the name and on behalf of all the beneficiaries of the services ordered by him on the Site of which he acknowledges to be the agent (hereinafter: the “Beneficiaries”) and to whom these GCS will be enforceable.

The Customer is financially responsible for the use of the Site made both in his name and on behalf of the Beneficiaries, unless he demonstrates fraudulent use resulting from no fault or negligence on his part.

The Customer guarantees the veracity and accuracy of the information provided by him in his name and in the name and on behalf of all Beneficiaries using his data on the Site.

The Company reserves the right at any time not to contract with a Customer who makes fraudulent use of the Site or who contravenes these GCS.

In this regard, it is recalled the terms of Article 313-1 of the French Penal Code:

“Fraud is the fact, either by the use of a false name or a false quality, or by the abuse of a true quality, or by the use of fraudulent maneuvers, of deceiving a natural or legal person and thus determining it, to his prejudice or to the prejudice of a third party, to hand over funds, securities or any property, to provide a service or to consent to an act operating obligation or discharge. The scam is punishable by five years’ imprisonment and a €375,000 fine.”

 

III Right of withdrawal

Pursuant to the provisions of Article L 121-21-8 of the Consumer Code, the services offered on the Site by the Company are not subject to the application of the right of withdrawal provided for in Articles L. 121-21 et seq. of the Consumer Code in terms of distance selling.

Consequently, the services ordered on the Site are exclusively subject to the cancellation and modification conditions provided for in these GCS and the Customer will not be able to invoke the right of withdrawal.

 

IV Price

Prices are indicated in Euros. VAT is included in the rates offered. Any change in the applicable rate, or any modification or introduction of new legal taxes introduced by the competent authorities, will be automatically reflected in the prices indicated on the invoice date.

Rates are per room for the number of people indicated and according to the selected period.

The prices indicated include only the services strictly mentioned in the reservation. To the price mentioned in the reservation will be added the additional services provided by the hotelier during the stay and, if applicable, the tourist tax.

The prices mentioned on the Site are subject to change at any time by the Hotel without prior information or notice. Only the price indicated in the booking confirmation by the Company is contractual.

No stay booked before the implementation of a possible promotional offer will be subject to refund, even partial.

Choose to pay your bill in your currency when using your Visa or Mastercard credit card and benefit from the best exchange rate and the most advantageous exchange commissions when you leave.

 

V Online orders

The Customer must, when placing his order:

– fill in the identification form on which he will indicate all the contact details requested or give his Customer number if he has one,

– fill in the online order form giving all the references of the products or services chosen,

– validate his order after having verified it,

– make the payment under the conditions provided and confirm his order and payment in case of option for a pre-payment plan (advance  purchase),or transmit to the Company his bank details in case of option for a flexible plan.

– Booking more than 5 rooms may result in different policies and additional charges.

The confirmation of the order entails acceptance of these conditions of sale, the acknowledgment of having perfect knowledge of them and the renunciation to avail oneself of one’s own conditions of purchase or other conditions.

All the data provided and the recorded confirmation will be proof of the transaction. The confirmation will be worth signature and acceptance of the operations carried out.

The Company transmits to the Customer, by any means (e-mail, simple mail, etc.), the confirmation of the registered order.

The reservation is firm and final only after receipt of the confirmation sent to the Customer by the Company.

The rates, terms and conditions of the reservations are intended for the sale of hotel rooms in accordance with their primary purpose: accommodation. The hotel reserves the right to modify or cancel the reservation(s), as well as the rates and conditions if the rooms are used for other purposes such as parties, dinners, meetings, photo or video shoots, film or interview shoots, written or filmed interviews, shootings for social networks,  showrooms etc … (non-exhaustive list) without the prior written consent of the management. The number of guests in the rooms cannot exceed the number of people booked and cannot exceed the maximum capacity of the rooms declared to the Prefecture of Police of Paris (declaration available from the hotel management).

 

VI Online payment terms

Depending on the type of reservation made, the price is due in full at the time of placing the order (advance  purchase pre-payment plan) or at the end of the Customer’s stay at the Hotel (flexible plan).

In any case and in order to guarantee his reservation, the Customer is asked to communicate his credit card number, the transmission being done by secure mode.

In case of payment at the time of placing the order, the credit card information transmitted by the Customer through a secure system to the Company allows the latter to debit the card for the total amount of the stay, always in a secure manner. The Customer’s bank account is debited on the day of the order, the invoice being transmitted by the Company to the Customer on the day of his departure from the Hotel.

Please note that the credit card used to make the reservation must be presented upon arrival by the bearer. Otherwise, a new credit card will be requested for payment on arrival.

In the case of a third party taking charge of the stay, the hotel will require documents for the security of the transaction.

Please also note that the hotel reserves the right to pre-authorize your credit card at any time prior to arrival.

 

VII Modification and/or cancellation of a reservation

Cancellations and/or changes to reservations may be authorized according to the rate plan chosen by the Customer.

In the event of an option for a flexible plan, any request for modification and/or cancellation of a reservation must be made as soon as possible and at the latest within the following deadlines:

In low and medium season (except periods of trade shows and special events): at least 24 hours before the start of the stay.

During high season and trade fair periods: at least 48 hours before the start of the stay.

During special events, this period is extended to 72 hours.

The modification and/or cancellation of a reservation is firm and final only after receipt of a confirmation by email from the Company.

The date of receipt of the request for modification and / or cancellation (by email, mail, telephone) is the date chosen for the cancellation.

In case of option for an advance   purchase pre-payment plan, no modification or cancellation will be accepted and the total amount of the stay will remain acquired at the Hotel without the Customer being able to claim any refund.

In case of no-show of the Customer at the Hotel and in the absence of cancellation:

– the total amount of the reservation will be kept by the Hotel in case of reservation “Plan in pre-payment, advance,  purchase”;

– The first night will be charged by the Hotel in case of reservation “Flexible Plan”.

In addition, for a stay of at least 2 nights, in case of no-show of the Customer on the first day of the stay, the Hotel is not required to keep the room for the remaining duration of the stay.

The Customer is asked to plan an arrival at the Hotel before 18:00 and to notify the hotelier in case of late arrival, under penalty of being considered as not having presented himself on the first day of the stay.

 

VIII Unloging

In case of non-availability of the Hotel or in case of force majeure, the latter reserves the right to have the Customer accommodated totally or partially in a hotel of equivalent or higher category, offering services of the same nature. The transfer will then be the responsibility of the hotelier who can not be sought in payment of any additional compensation.

 

IX Services annexes – Packages

Orders for ancillary services and/or packages can only be placed at the same time as the reservation of a stay within the establishment on a given and predetermined date.

They may only be used by the Customer during his stay at the Hotel. They may be modified and/or cancelled only under the conditions of Article VII hereof.

 

X Force majeure

Force majeure means any event external to the parties of a character that is both unforeseeable and insurmountable that prevents either the customer or the hotelier from fulfilling all or part of the obligations provided for in the contract.

This is particularly the case in the event of strikes, insurrections, riots, prohibitions issued by government or public authorities.

It is expressly agreed that force majeure suspends, for the parties, the performance of their reciprocal obligations and that each party bears the burden of the resulting costs.

In particular, Customers will bear only the additional costs that may be incurred to allow the continuation of the trip, following the occurrence of a case of force majeure.

 

XI Claims

Any complaint must be addressed to the following address: Hostellerie Le Mirabeau, 1200 route des Alpes, 13860 Peyrolles en Provence, within 2 years of the departure of the stay that is the subject of the said complaint. After this period, no claim can be taken into account.

In the event of a dispute and as a consumer, you have the possibility of having recourse to a mediator.

XII Data protection

In application of the law 78-17, known as informatique et libertés, customers are warned that their reservation is subject to computerized nominative processing. Customers have a right of access and rectification of the data entered, which is exercised at the registered office: Hostellerie Le Mirabeau, 1200 route des Alpes, 13860 Peyrolles en Provence. It is specified that this information is not communicated to third parties.

The Company offers wi-fi internet access. The Customer undertakes that the computer resources made available to him will not be used in any way for the purposes of reproduction, representation, making available or communication to the public of works or objects protected by copyright, by a related right such as texts, photographic images, audiovisual musical works,  software and video games, without the authorization of the holders of the rights provided for in Book I and II of the Intellectual Property Code when such authorization is required.

The Hotel has a video surveillance system in the common areas of the building as well as the car park.

 

XIII Responsibilities

The Company declines all responsibility in case of theft, loss, degradation of the effects belonging to the customers during their stay.

The Customer will be held responsible for any damage, any degradation, any act of vandalism that may occur due to the occupation of the premises and / or the fact of the participants and / or the staff for which he is responsible, both to movable, decorative and immovable property belonging or not to the hotel. Therefore, the Company has any right to ask the Customer to leave the establishment without any compensation and without any refund of the current stay, and to reimburse the damage caused by these acts.

The Company, in the process of online sales, is only bound by an obligation of means. It cannot be held liable for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, interruption of service, or other involuntary problems.

 

XIV Ley Applicable

These General Terms and Conditions of Sale are governed by French law. This is the case for both substantive and formal rules. Disputes will fall under the exclusive jurisdiction of the French courts.
